Shoplifting Laws in Massachusetts

Chapter 266, Section 30 of the Massachusetts General Laws provides a clear definition of shoplifting. The crime is considered if you have taken an item out of the store with the intention of not paying for it. 

Another thing that can also be considered a crime is changing the price tag of any item in the shop intentionally so that you might get the chance to scam the business by paying a lower price. 

Penalties

Felony offense: Penalties for times that are under $100 are as follows:

  • You will end up in jail for six months
  • $500 in fines, it is better to pay upfront rather than paying 5x the price in penalties? 

Criminal: Over $100 worth of goods may be prosecuted as felonies, which carry sentences of one to five years in prison.

  • The number of penalties can be greater!

Retailers may pursue more damages under Massachusetts law since it permits civil recovery as well.
